By downloading, accessing, or using PixelyChat (the "Software") and its associated website, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

2. License Grant

PixelyChat grants you a personal, non-exclusive, non-transferable, and revocable license to install and use the Software for personal and commercial streaming purposes, strictly in accordance with these Terms.

3. Acceptable Use

You agree not to use the Software to:

  • Violate any laws, third-party rights, or the Terms of Service of connected platforms (such as Twitch, YouTube, Kick, or TikTok).
  • Reverse engineer, decompile, or disassemble the Software.
  • Attempt to bypass any API rate limits or security mechanisms implemented by us or our platform partners.
  • Distribute malicious code or participate in automated chat spamming.

4. Third-Party APIs and Services

PixelyChat interacts with third-party APIs (including YouTube API Services, Twitch API, etc.). Your use of these features is subject to the respective third parties' terms of service (e.g., the YouTube Terms of Service). We are not responsible for the availability, uptime, or functionality of these third-party services. If a platform alters its API, PixelyChat functionality may be temporarily or permanently impacted.

5. Intellectual Property

All intellectual property rights in the Software, including design, code, graphics, and logos, are owned by PixelyChat. The application relies on official logos of third-party platforms (Twitch, YouTube, Kick, TikTok) solely for identification purposes within the user interface, and these remain the property of their respective owners.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE." PIXELYCHAT EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

7. Limitation of Liability

IN NO EVENT SHALL PIXELYCHAT, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF REVENUE, PROFITS, OR DATA, ARISING OUT OF YOUR USE OR INABILITY TO USE THE SOFTWARE.

8. Termination

We reserve the right to terminate or suspend your access to the Software at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users of the Software, us, or third parties.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the business entity operates, without regard to its conflict of law provisions.
